What are community rules?
The community rules of a condominium owners' association are the entirety of the agreements between the condominium owners. They regulate the relationship between the owners. Similar to a statute, the community rules form the basis for the coexistence of the condominium owners.
The explanatory memorandum to the 2007 amendment to the German Condominium Act states the following:
"The condominium owners shall regulate their affairs by means of agreements insofar as they wish to deviate from or supplement the statutory provisions and insofar as the law does not permit decisions by (majority) resolution. In practice, the term "community rules" has also become established for these agreements. According to the system of the law, these also include the provisions with which a sole owner determines the relationship between the condominium owners when establishing condominium ownership through division."
